The Donald Trump’s case

Donald Trump, business man, TV star and 45th President of the United States, has been
indicted by the Manhattan Grand Jury for a 130.000 dollar payment, done to the pornostar
Stormy Daniels during the 2016 elections, to keep her quiet about their relationship.
It’s the first time in the United States history that a former president has to face a criminal
charge: however, for the American Establishment and laws this won’t stop him from the 2024
elections for the office of President of the USA. His partner has already launched a new
fundraising campaign, while Joe Biden is getting ready for the elections as well.
The trial is based on over 30 charges of corporate fraud and, since the first hearing, New
York was armored with exceptional security measures in the most dangerous places, after
Trump had incited his followers to protest and to “take back the Country”, raising the “death
and destruction” risk.
Mug shots and fingerprinting, but still no handcuffs and no admission of guilt for Donald
Trump. His lawyers warn: “There isn’t a manual to see how to charge a former US president
in a criminal court”.
“As every other defendant” Donald Trump is legitimated to answer to the accusations and to
use all the protections the New York State offers. “What neither Trump nor the Congress
couldn’t do is to interfere in the ordinary course of State proceedings”. Manhattan prosecutor
Alvin Bragg affirmed it in a letter to Jim Jordan, Bryan Steil and James Comer, the
Republican Presidents of three Committees of the Chamber, who have asked magistrate’s
testimony and documents of the inquiry about the presumed payments to the pornostar
Stormy Daniels.
Another trial with the charge of rape and defamation has been added to the initial one, still
ongoing. Nevertheless, Donald Trump has had no success in his attempt to archive the
latter. A New York judge rejected former President’s request and writer E. Jean Carol’s
accusations officially remain. The woman reported Trump for a presumed rape happened to
her detriment in a shop of Manhattan Bergdorf Goodman chain between the end of 1995 and
the beginning of 1996.
Trump has always denied his involvement, defining the charges “invented”.
Moreover, the lawyers that defend the former President have just cross-examined E. Jean
Carroll.
Anyway, the trial began last week in a New York federal court and will definitely keep going.

Donald Trump, uomo d’affari, star televisiva e 45esimo presidente degli Stati Uniti, è stato
incriminato dal gran giurì del tribunale di Manhattan per un pagamento di 130.000 dollari
fatto alla pornostar Stormy Daniels durante le elezioni del 2016, per farla tacere sulla loro
relazione.
E’ la prima volta nella storia degli Stati Uniti che un ex presidente deve affrontare un’accusa
penale: una mossa che tuttavia per la Costituzione e le leggi americane non gli impedirà le
successive elezioni del 2024 per la carica di presidente degli USA. La sua compagna ha già,
infatti, lanciato una nuova campagna di raccolta fondi, mentre anche Joe Biden si prepara
alle elezioni.
Il processo si basa su oltre 30 capi di accusa di frode aziendale e, sin dalla prima udienza,
New York è stata blindata con eccezionali misure di sicurezza nei luoghi più sensibili, dopo
che Trump aveva aizzato i suoi a protestare e a “riprendersi il Paese”, evocando il rischio di
“morte e distruzione”.
Foto segnaletica e rilevazione delle impronte digitali, ma ancora niente manette e nessuna
ammissione di colpevolezza per Donald Trump. I suoi avvocati avvisano: “Non esiste un
manuale per vedere come si accusa un ex presidente degli Stati Uniti in un tribunale
penale”.
“Come ogni altro imputato” Donald Trump è legittimato a impugnare le accuse in tribunale e
avvalersi di tutte le tutele che il sistema penale dello Stato di New York offre.
“Quello che né Trump né il Congresso potrebbero fare è interferire nel corso ordinario dei
procedimenti dello Stato”. Lo ha affermato il procuratore di Manhattan Alvin Bragg in una
lettera indirizzata a Jim Jordan, Bryan Steil e James Comer , i Presidenti Repubblicani di tre
Commissioni della Camera, i quali hanno chiesto la testimonianza del magistrato e
documenti dell’indagine sui presunti pagamenti alla pornostar Stormy Daniels.
Al processo iniziale ancora in corso se n’è aggiunto un altro con l’accusa di violenza
sessuale e diffamazione. Ciò nonostante, Donald Trump non ha avuto nessun successo nel
suo tentativo di far archiviare quest’ultimo. Un giudice di New York ha respinto la richiesta
dell’ex presidente e le accuse della scrittrice E. Jean Carol restano ufficialmente in piedi. La
donna ha denunciato Trump per una presunta violenza sessuale avvenuta a suo danno in un
negozio della catena Bergdorf Goodman di Manhattan tra la fine del 1995 e l’inizio del 1996.
Trump ha sempre negato il suo coinvolgimento, definendo le accuse “inventate”.
Inoltre, i legati che difendono l’ex presidente hanno appena sottoposto E. Jean Carroll a un
controinterrogatorio.
Comunque, il processo è iniziato la scorsa settimana in un tribunale federale di New York e
andrà sicuramente avanti.
